By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

You must be at least 13 years old to use the Service. By creating an account you represent that you are at least 13 years old and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of Service

Acaba is an AI-powered platform that helps creators and marketers research TikTok trends, generate video scripts, manage content campaigns, and schedule posts. Core features include:

  • AI script and hook generation using large language models
  • TikTok analytics and trend research via the TikTok API
  • Asset library and video variant management
  • Content scheduling and calendar management

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate and current account information
  • Notify us immediately of any unauthorized use of your account
  • Not share your login credentials with any third party
  • Use a strong, unique password and enable two-factor authentication where offered

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Scrape, crawl, or harvest data from the Service or any third-party platform (including TikTok) in violation of their Terms of Service
  • Abuse or circumvent API rate limits imposed by TikTok or any other third-party service integrated with Acaba
  • Generate, upload, or distribute content that is defamatory, obscene, harassing, or infringes the intellectual property rights of others
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
  • Attempt to gain unauthorized access to any part of the Service or its related systems
  • Use the Service for any automated bulk-messaging, spam, or coordinated inauthentic behavior on any social media platform

5. TikTok Platform Compliance

The Service integrates with the TikTok API through TikTok's official Login Kit and developer platform. By connecting your TikTok account you agree to also comply with TikTok's Terms of Service and TikTok's Community Guidelines. You are solely responsible for ensuring that your use of TikTok data obtained through Acaba complies with TikTok's developer policies. Acaba is not affiliated with, endorsed by, or sponsored by TikTok or its parent company ByteDance Ltd.

6. Content Ownership

You retain all ownership rights to the content you create, upload, or generate through the Service ("Your Content"). By using the Service you grant Acaba a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely as necessary to provide the Service to you.

We do not use Your Content to train AI models. We do not claim any ownership over scripts, campaigns, or other materials you generate using Acaba's tools.

7. Intellectual Property

The Service and its original content (excluding Your Content), features, and functionality are and will remain the exclusive property of Acaba. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Third-Party Services

The Service may integrate with or link to third-party services (TikTok, Google Calendar, YouTube, Instagram). We are not responsible for the content, privacy practices, or terms of those services. Your use of third-party services is governed by their respective terms.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Acaba shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid to Acaba in the twelve (12) months preceding the claim, or $100 USD if you have not made any payments.

11. Termination

We may suspend or terminate your access to the Service at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. You may cancel your account at any time from Dashboard → Settings → Account. Upon termination, your right to use the Service will immediately cease. Sections 6, 7, 9, 10, and 12 survive termination.

12. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of those Terms.
